ARBITRATION
JHJ Arbitration offers the service as an Arbitrator for construction and IT contract disputes.
Arbitration has many advantages over a court process.
- Arbitration is a cheaper and quicker alternative to litigation. It allows both parties to determine the issues to be resolved by the arbitrator.
- The ‘Award’ (or outcome) of the arbitration is legally binding and can be enforced by the courts.
- If a contract contains an ‘Arbitration Agreement’ the dispute cannot be litigated and must be arbitrated (unless otherwise agreed by both parties).
- The procedure for an arbitration may be agreed by both parties and thereby achieve a more flexible and efficient process compared to a court. Both parties may agree to conduct the arbitration with no oral evidence at all. In this instance, the arbitrator will make their award based on the documents presented by both parties.
- Arbitration is private and confidential. Unlike litigation, the evidence presented and the award will not be in the public domain. The outcome remains confidential.
- An arbitration award in final and binding, and may be enforced by the court. The options for an appeal against an award are more limited than from a court decision.
